These Terms & Conditions ("Terms") govern your use of Kohay Agency LLC's ("Kohay," "we," "us") website and marketing services, including video production, social media management, paid advertising, and website creation. By booking a consultation, purchasing a package, or otherwise engaging our services, you agree to these Terms.
Kohay provides:
Short-form video production — content strategy, scripting, on-site filming in New York City, and editing for Instagram Reels, TikTok, and YouTube Shorts. Offered as fixed-scope packages ("Starter," "Growth," "Scale"), available with on-site filming or as editing-only for footage you provide.
Monthly retainer services — Instagram management, Meta and Google advertising, and full client acquisition systems. Billed monthly and continue until cancelled by either party per the terms below.
One-time projects — website and landing page creation, billed as a separate project at an agreed price.
Payment methods — we accept payment via secure Stripe checkout (card) or direct Zelle transfer to the Kohay Agency LLC company account. Zelle details are provided on request at checkout.
One-time packages are purchased in advance. Work begins once payment is confirmed (for Zelle, once the transfer is received) and, where applicable, once you've provided the information or footage needed to start.
Monthly services are paid in advance for each billing period, by either payment method. Invoices are issued at the start of each month of service; services are provided for the paid period.
Prices listed on the site are in US dollars and may change at any time; the price at checkout applies to your purchase.
Consultation calls booked through our scheduling link are free and non-binding. Booking a call does not commit you to a purchase.
Each package includes up to 3 rounds of revisions. Revision requests must relate to the agreed scope, scripts, and creative direction discussed during planning. Requests that materially change the scope of the project may be treated as a new project or billed separately.
Applies to video production packages. Estimated turnaround times are communicated after booking and depend on package size, filming schedule, and how quickly footage or feedback is provided. Final files are delivered digitally, ready to publish.
Applies to filming packages. On-site filming is available for businesses and experts across New York City. You are responsible for ensuring access to the agreed location, necessary permissions, and a safe filming environment on the scheduled date. Rescheduling requests should be made as early as possible; late cancellations may be subject to a rescheduling fee.
One-time packages: because packages involve planning, scheduling, and creative work that begins shortly after payment, purchases are generally non-refundable once work has started. If you need to cancel before work begins, contact us and we'll do our best to find a fair resolution.
Monthly services: either party may end the engagement with 14 days' notice before the end of the current billing period. The current paid period is delivered in full; no refund is issued for the unused portion of a paid period.
Refunds, if issued, are processed back to the original payment method — via Stripe for card payments, or by return transfer for Zelle payments.
Once a project is paid in full, you receive full usage rights to the final delivered work for your business's marketing purposes. Kohay retains the right to use completed work (with your permission) in our portfolio, website, and social media, unless you request otherwise in writing.
You're responsible for providing accurate information about your business, timely feedback during revision rounds, and — for editing-only packages — usable footage for the agreed number of reels. For monthly services, you're also responsible for providing access to relevant accounts and ad platforms, and timely approval of content and ad budgets. Delays may affect delivery timelines.
Kohay provides creative and production services on a best-effort basis. We are not liable for indirect, incidental, or consequential damages arising from the use of delivered content, including business results, ad performance, or platform algorithm changes. Our total liability for any claim is limited to the amount paid for the relevant service.
Either party may end an ongoing engagement if the other materially fails to meet their obligations under these Terms. Work completed and delivered up to that point remains billable.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date.
